1. Terms and definitions
1.1. Administration (Right Holder) — the person that manages the Service, holds the exclusive rights to the software of the Application and the website, organizes the processing of personal data and provides access to the Service on the terms of this Agreement. Contact details are given in Section 12.

1.7. Device — hubs, scales and other equipment of the User connected to the Application via Bluetooth for data transfer. Devices are the property of the User. The Administration is not the seller, manufacturer or service center of the Devices.
1.8. Blocking — temporary or permanent restriction of the User's access to the Account and related data.
1.9. Account deletion — deletion of the Account and the data associated with it from the active database of the Service (data may be retained in backups for the duration of their technical rotation cycle).
Terms may be used in the singular or plural. Section headings are for navigation only and do not affect the interpretation of the terms.
2. Subject of the agreement. Scope of services
2.1. The subject of the Agreement is the provision by the Administration to the User of access to the functionality of the Application for monitoring and managing Devices, synchronizing data in the cloud and accessing it from different devices, as well as the regulation of the procedure for using the Service, the rights and obligations of the parties and their liability.
2.2. The scope of services includes:
- provision of a software interface (the mobile Application and, where necessary, a web interface) for viewing and managing data from Devices;
- storage and synchronization of data (measurements, settings, notes, etc.) in the cloud;
- technical support on matters related to the operation of the Service (to the extent determined by the Administration).
2.3. The scope of services does NOT include, and the Administration does NOT provide:
- communication services (internet access, Bluetooth, operation of the User's equipment);
- sale, warranty and post-warranty servicing of Devices;
- calibration, configuration, repair or replacement of Devices.
2.4. The Administration may change the list of functions of the Service without prior notice to Users.
3. Registration and account
3.1. Registration and use of the Service are permitted only to persons who have full legal capacity under the laws of their country of citizenship/residence. Registration is prohibited for persons under 18. By registering, the User confirms compliance with this requirement.
3.2. The User must provide accurate data during registration and keep the password (and other credentials) confidential. All actions performed using the Account are deemed to have been performed by the User. In the event of unauthorized access, the User must immediately change the password and/or contact support.
3.3. The Administration applies technical measures to protect accounts (including storing passwords in hashed form). The Administration never requests passwords by email, phone or messengers — such requests are fraudulent.
3.4. The User may delete the account and associated data using the functionality of the Application. After deletion, recovery of data and access is not possible. Deletion at the initiative of the Administration is carried out in accordance with Section 6.
4. Devices and data
4.1. Devices are purchased and maintained by the User independently. Matters of quality, warranty and repair of Devices are to be resolved with the seller/manufacturer. The Administration does not guarantee the compatibility of specific equipment models with the Application.
4.2. The User independently ensures that their device (phone/tablet) is connected to the internet and that Bluetooth is enabled to work with Devices. The Administration is not responsible for the operation of communication networks, connection quality or the stability of data transmission.
4.3. The Administration does not guarantee the absolute accuracy, continuity and integrity of the data displayed in the Service. Readings may contain errors; delays, failures and data loss are possible. The data is provided for information and reference purposes only. The Administration is not liable for decisions made by the User on the basis of this data.
5. Acceptable use. Prohibitions
5.1. The User undertakes to use the Service only for lawful purposes, in accordance with the Agreement and applicable law.
5.2. The following is prohibited: using the Service to distribute malware or spam; unauthorized access to servers, accounts or data; disrupting the operation of the Service or circumventing technical restrictions; copying, extracting or commercially using data of the Service without the consent of the Administration (except for personal use of one's own data).
5.3. Violation of the rules may result in blocking of access or deletion of the account without prior notice.
6. Blocking and deletion of the account by the Administration
6.1. The Administration may at any time block access to the Account or delete the account (including unpairing Devices and deleting data) at its own discretion — manually or automatically. The Administration is not obliged to notify the User of blocking/deletion and is not obliged to disclose the reasons. The decisions of the Administration are final.
6.2. Blocking/deletion is possible in the following cases: violation of the terms of the Agreement; a request from competent state authorities; other grounds at the discretion of the Administration. Access is restored by decision of the Administration and is not guaranteed.
7. Data and privacy
7.1. Personal and other data are processed in accordance with the Personal Data Processing Policy of the Service. Use of the Application constitutes consent to its terms.
7.2. When an account is deleted, the data is deleted from the active database; it may be retained in backups for the duration of the rotation cycle (as a rule, up to 30 days) and is then deleted irreversibly.
8. Intellectual property
8.1. The Application, the website, the design, texts, program code and other materials of the Service are objects of intellectual property of the Administration and are protected by the laws of the Republic of Belarus and international agreements.
8.2. The Administration grants the User a limited, non-exclusive, non-transferable license to use the Application in accordance with its intended purpose and this Agreement. No ownership rights to the Service are transferred to the User.
8.3. Without the written permission of the Administration, it is prohibited to: reproduce, copy or distribute materials of the Service; decompile or disassemble the code; use automated means for mass data collection; remove copyright notices.
9. Liability and limitation of liability
9.1. The Service is provided “as is”. The Administration does not guarantee uninterrupted and error-free operation of the Application and servers, the integrity of data, or the suitability of the Service for the User's particular purposes. The User uses the Application at their own risk.
9.2. To the maximum extent permitted by applicable law, the Administration shall not be liable for direct, indirect or incidental damages, lost profits, loss of data or non-pecuniary damage arising in connection with the use of or inability to use the Service, Devices or data obtained through the Service, even if the Administration has been advised of the possibility of such damage. The Administration is not responsible for: malfunctions of Devices and equipment; communication and data transmission failures; temporary unavailability of the Service (maintenance, hosting, actions of third parties); loss of data due to failures, hacking or force majeure.
9.3. Monetary limitation. If a court nevertheless finds the Administration liable to pay compensation, the aggregate liability of the Administration to the User for all claims related to the Service is limited to 10 (ten) Belarusian rubles. The limitation applies regardless of the number of grounds and the amount of actual damage.
9.4. Force majeure. The Administration is released from liability for non-performance of obligations if it is caused by force majeure circumstances (war, natural disasters, acts of state authorities, failures of global networks, etc.) that arose after the conclusion of the contract.
10. Amendment and termination of the agreement
10.1. The Agreement enters into force upon Acceptance and remains in effect until terminated.
10.2. The Administration may unilaterally amend the Agreement. The new version enters into force upon its publication in the Application and/or on the website. The User undertakes to check the current version independently. Continued use of the Service after the changes enter into force constitutes consent to the new version. If the User does not agree, the User must stop using the Service and delete the account.
10.3. The User may terminate the contract at any time by deleting the Account (Section 3.4). Termination at the initiative of the Administration is carried out in accordance with Section 6.

11. Dispute resolution. Governing law
11.1. The Agreement and all relations related to the use of the Service are governed by the laws of the Republic of Belarus.
11.2. Pre-trial claim procedure. In the event of disputes, the User must send the Administration a written claim. The period for consideration is 30 (thirty) calendar days from the date the Administration receives the claim.
11.3. If no agreement is reached, the dispute shall be heard by the court at the location of the Administration in accordance with the laws of the Republic of Belarus.
11.4. Notices, claims and other documents under the Agreement shall be drawn up in Russian or Belarusian.
11.5. If any provision of the Agreement is held invalid, this shall not entail the invalidity of the remaining provisions.
